According to state and federal authorities, Americans spill 180 million gallons of used oil each year into our waterways. This is 16 times the amount spilled by the Exxon-Valdez Incident. The law states: ACCIDENTAL OR NOT, under Federal law (the Oil Pollution Act and Clean Water Act), it is illegal to discharge any amount of fuel, oil or other petroleum product, into the drains or waterways of the United States. By law, any oil or fuel spill that leaves a sheen on the roadway or water surface must be reported and cleaned up.


Tow and recovery technicians are and always have been liable by law for the cleanup of all debris and pollutants associated with vehicle(s) they are assigned to remove from an accident scene. 


ORS 468B.025 (Oregon Revised Statutes) - Prohibited Activities

1. Except as provided in ORS468B.050 or 468B.053, no person shall: 

  a) Cause pollution of any waters of the state or place or cause to be placed any wastes in a location where such wastes are likely to escape or be carried into the waters of the state by any means.

  b) Discharge any wastes into the waters of the state if the discharge reduces the quality of such waters below the water quality standards established by rule for such waters by the Environmental Quality Commission.
